Terms of Service

By accessing or using GameTape ("the Platform"), operated by GameTape, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. By using the Platform, you consent to the collection, processing, and use of information as described in our Privacy Policy.

1. Service Description

GameTape is a live basketball statistics, streaming, and highlight platform. The Platform provides real-time stat tracking, live video streaming, auto-generated stat cards, highlight clips, player profiles, and leaderboards.

2. Eligibility

You must be at least 13 years old to use the Platform. If you are under 18, you must have parental or guardian consent. Players under 18 must have a parent or guardian sign the Player Participation & Media Consent Form before participating.

3. Player Participation

Players who participate in games tracked by GameTape must sign a Player Participation & Media Consent Form prior to any recording, streaming, or stat tracking. By signing the consent form, players agree to have their name, jersey number, performance statistics, likeness, and highlight clips displayed on the Platform and shared on associated channels.

4. Stat Accuracy Disclaimer

Statistics displayed on the Platform are manually tracked by human scorers and may contain errors. GameTape does not guarantee the accuracy, completeness, or timeliness of any statistics. Stats are provided for entertainment and informational purposes only and should not be relied upon for any official, competitive, or professional evaluation.

5. No Gambling

The Platform may offer free prediction games for entertainment purposes only. No real money, cryptocurrency, or items of monetary value are wagered, won, or lost. GameTape does not operate, facilitate, or endorse gambling of any kind.

6. Content Ownership & Data Usage

Platform Content: GameTape owns all rights to the broadcast production, stat card designs, graphic templates, overlay designs, and the compiled presentation of statistics.

Player Likeness: Players retain rights to their own name, likeness, and image. Players may request removal of their content by contacting us in writing.

Data Usage: We may use aggregated, de-identified performance data for analytics, product improvement, research, and promotional purposes. GameTape may share compiled performance data with sponsoring organizations, program administrators, and coaching staff for program administration purposes.

We reserve the right to sublicense, transfer, or assign any content rights to affiliates or successors.

7. Acceptable Use

You agree not to:

• Use the Platform to harass, bully, or intimidate any player, spectator, or staff member
• Attempt to manipulate statistics, scores, or prediction outcomes
• Interfere with the operation of the Platform or access functions without authorization
• Scrape, crawl, or automatically extract data without written permission
• Use the Platform for any illegal activity

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GAMETAPE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMETAPE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, ANY ERRORS IN STATISTICS OR CONTENT, UNAUTHORIZED ACCESS TO YOUR DATA, OR ANY OTHER MATTER RELATING TO THE PLATFORM.

10. Indemnification

You agree to indemnify and hold harmless GameTape and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Platform at any time, for any reason, without notice. Upon termination, provisions that by their nature should survive will remain in effect.

12. Modifications

We reserve the right to modify these Terms at any time. Changes are effective when posted. Your continued use of the Platform after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
